I I <br /> Town of Silverthorne <br /> Case No.04CW217 <br /> Page 3 <br /> Structure 3 located in the S/2 of Section 12,T5S, R78 W, <br /> 6`h P.M.at a point 1470 feet from the south <br /> section line and 2590 feet from the east section <br /> line of said Section 12 <br /> Although the precise location of the structures may,upon construction,be somewhat different <br /> from the locations described above, the structures will generally be distributed evenly through <br /> the stream reach described above. Provided that the locations of all the structures remain within <br /> the stream reach described above,any variation in structure location from the locations described <br /> herein will be simply described in subsequent applications for diligence or applications to make <br /> absolute the water rights claimed herein filed pursuant to paragraph 30,below. In any event, <br /> however,the location of Structure 1 (the furthest upstream structure)shall be constructed <br /> downstream of the confluence of Salt Lick Gulch and the Blue River <br /> 7.2 Source. Blue River,Salt Lick Gulch and Straight Creek,tributaries of the <br /> Blue River,a tributary of the Colorado River. <br /> 7.3 Appropriation Date. December 31,2004,by formation of intent by the <br /> Silverthorne Town Board of Trustees and filing the Application with the Court. <br /> 7.4 Amount and Use. <br /> Level One Flows,for passage of recreational watercraft, <br /> and beginner kayaking <br /> Month Flow(cfs) <br /> May 100;Conditional <br /> June 100; Conditional <br /> July 100;Conditional <br /> August 100;Conditional <br /> September 100;Conditional <br /> Level Two Flows,for use of water features created by <br /> the structures for intermediate to expert kayaking, <br /> rafting,and related activities <br /> Holiday Flow(cfs) <br /> Memorial Day 600; Conditional <br /> Independence Day 600;Conditional <br /> Labor Day 600;Conditional <br /> The claimed flows are for between the hours of 7:00 a.m.and 8:00 p.m.for both Level One and <br /> Level Two Flows. Level Two Flows are claimed for up to four days per weekend,depending on <br /> national holidays,and being no longer than Friday to Monday of each holiday.The amounts <br /> decreed herein are for recreational in-channel diversion between the course structures.
