Fronczak, Chief, Designated Basins Bran <br /> SUBJECT: Written Comments on Whether the Anti-Speculation Doctrine Applies within the <br /> Denver Basin aquifers of the Designated Basins <br /> At the next Ground Water Commission ("Commission") meeting, scheduled for on Friday, <br /> February 22, 2002, in Room 230 (Hayes Student Center) of the Northeast Junior College, in <br /> Sterling Colorado, the Commission is considering whether the Anti-Speculation Doctrine applies <br /> within the Denver Basin aquifers of the Designated Basins. To assist the Commission in their • <br /> decision with regard to this topic, the Commission Staff is soliciting comments from all <br /> interested parties. <br /> The Commission's decision on this issue will be in the form of a resolution and will finalize the <br /> Commission's position with regard to the Anti-Speculation Doctrine's application within the <br /> . Denver Basin aquifers of the Designated Basins. The Designated Basins that this decision may <br /> effect are the Lost Creek, Kiowa-Bijou, Upper Big Sandy and Upper Black Squirrel Creek <br /> Designated Basins. <br /> Please provide any written comments on this issue to the Commission Staff by January 28, <br /> 2002 such that the Staff may compile the comments and prepare a packet for each <br /> Commissioner prior to the meeting. Comments should be limited to whether the Anti- <br /> Speculation Doctrine applies, reasons for this conclusion and what speculative test should be <br /> applied, if any.
