As stated in the Lower Arkansas Valley Water Conservancy District's ("LAVWCD")
2005 Agricultural Emergency Drought Grant Application(April 26, 2005), the
• LAVWCD will be requesting an agricultural emergency drought grant of up to
$75,000 to pay for water to replace Colorado's stateline obligations pursuant to
Kansas v. Colorado in 2006.
2. The primary contact for this Application is Peter D. Nichols,Esq., Trout, Raley,
Montano, Witwer&Freeman, P.C., 1120 Lincoln Street, Suite 1600, Denver, CO
80203; Tel: 303-339-5825; e-mail: pnichols @troutlaw.com. Mr.Nichols is Special
Counsel to the LAVWCD.
3. The purpose of the grant is to reimburse the LAVWCD for its costs to acquire water
to meet Colorado's obligation to Kansas for drought-related unreplaced stateline
depletions due Kansas under Kansas v. Colorado. Steve Witte, Division Engineer,
recently(May 17,2006) estimated Colorado's obligation could be as high as 10,700
acre-feet using the court-approved H-I Model. Mr. Witte is working to refine this
estimate, and the LAVWCD will submit a final 2006 Agricultural Emergency
Drought Grant Application as soon as possible after Mr. Witte finalizes Colorado's
2006 obligation.
The LAVWCD has leased 4,960 acre-feet from the Pueblo Board of Water Works to
date that it will make available for this purpose. In addition, the LAVWCD is
prepared to make additional water available from the Larkspur Ditch, and possibly
Twin Lakes and Colorado Canal/Lake Meredith.
•
