I2_.3 RECONNECT FEE. If water service is discontinued pursuant to Article XI., Section <br /> 11.3, the appropriate Company reconnect fee will be charged as provided in Appendix C. <br /> 12.4 DEPOSIT FOR INCLUSION WITHIN THE SERVICE AREA. If a petition is filed <br /> with the Company for inclusion within the Service Area, the applicant shall deposit the <br /> appropriate sum with the Company as set forth in Appendix G to defray the attorney, <br /> publication and other costs of the inclusion process. The applicant is responsible for all <br /> actual costs of the inclusion process. <br /> [If there are no "service area" issues then this section is not applicable.] <br /> 12.5 COMPANY REPAYMENT FOR WATER MAIN INSTALLATION. <br /> The Company may reimburse a customer who extends, at their own cost, a water main to <br /> serve their property, or who pays the Company to extend a water main, an amount as set <br /> forth in Appendix D. <br /> 12.6 DEPOSIT. The company may require a customer or applicant to deposit an amount not <br /> to exceed that of an estimated ninety (90) day bill for the individual. If, at its cost, the <br /> Company is required to extend lines and facilities in order to furnish water service to a <br /> customer or applicant, the required deposit may be established for an estimated bill for a <br /> period longer than ninety(90) days. The deposit is refundable upon payment of all <br /> installation and equipment charges where applicable or upon the customer's <br /> establishment of good credit with the Company. <br /> 12.7 CHARGES AS LIEN. Until paid, all Company fees, rates, tolls, penalties or charges <br /> constitute a perpetual lien on and against the property served. The lien may be foreclosed <br /> in the manner provided by the laws of Colorado. <br /> 12.8 LIABILITY FOR PAYMENT. The property owner shall be equally liable with the <br /> customer, if the customer is not the property owner, for charges due the Company. The <br /> Company holds the property owner and the customer jointly liable for all water service <br /> charges at the address where the bills are sent. <br /> ARTICLE XIII. ADMINISTRATIVE REMEDY <br /> The customer has thirty (30) days following Company action within which to protest in writing to <br /> the Commission concerning that company action. The Commission shall review the protest at its <br /> next regular meeting. This administrative procedure is a necessary precondition to court action. The <br /> customer's failure to follow this administrative procedure shall be deemed a waiver of the <br /> customer's administrative remedy and the customer's right to court remedies. <br /> ARTICLE XIV. COMPANY RESTRICTION OF CUSTOMER WATER USE <br /> Whenever there is a shortage of water, caused by limitation of Company facilities, fire or other <br /> emergency, or limitations placed on the Company by any governmental entity, or when, in the <br /> opinion of the Commission, an emergency exists, the Commission has power to regulate and curtail <br /> 13 <br />
