ARTICLE X. APPLICATION FOR WATER SERVICE <br /> 10.1 DENIAL OF SERVICE. The Company reserves the right to deny water substantial <br /> threat to the continued operation of the Company. Denial may also be based upon an <br /> unresolved obligation between the Company and the applicant or for other valid reasons. <br /> Upon denial of service, the Company shall refund, without interest, all refundable fees <br /> paid by the applicant. <br /> 10.2 INCLUSION WITHIN THE COMPANY'S SERVICE AREA. <br /> [Are there any issues to be addressed relative to the Company's proposed service area <br /> and the boundaries of the Pine River Irrigation District? If not, the following sections are <br /> not relevant.] <br /> An owner of property outside the Company's Service Area's boundary who wishes to <br /> have the property included within the Service Area, shall petition for this inclusion. The <br /> petition shall be acted upon in compliance with the Company's contractual obligations <br /> and the provisions of C.R.S., §32-1-401 through 402. <br /> The applicant for inclusion shall pay the Company a nonrefundable deposit upon <br /> petitioning for inclusion. The amount of the deposit is provided in Appendix D. The <br /> deposit shall be used to defray the attorney, publication, court and other costs of the <br /> inclusion process. <br /> The applicant for inclusion within the Company's Service Area shall pay all actual <br /> attorney, publication, court and other costs associated with the inclusion process <br /> regardless of whether the property is finally included within the Company's Service <br /> Area. <br /> Upon inclusion of the property within the Service Area, the applicant for Company water <br /> service shall comply with the procedures outlined in Article X, Section 10.4, of these <br /> Rules and Regulations. <br /> 10.3 SERVICE OUTSIDE THE SERVICE AREA. Upon written application of the property <br /> owner(s), the Company may furnish water service to (a) property owner(s) outside the <br /> Service Area subject to the Company's contractual and statutory obligations. The <br /> express written consent of the Commission is required for the provision of water service <br /> outside the Service Area. <br /> The Commission shall consider the best interests of the Company in determining the fees, <br /> deposits, conditions and duration of a contract for water service on a property located <br /> outside the Service Area. <br /> The Commission at its discretion may charge higher tap fees and water rates for property <br /> located outside the Service Area. Cost for service outside the Service Area shall equal at <br /> least the cost of service, plus the estimated mill levy and tap fees for which such property <br /> would be responsible if it were within the Service Area. <br /> 10 <br />
