Box 1120, Glenwood Springs, Colorado 81602 <br /> hereinafter referred to as the contractor/Contractor. <br /> WHEREAS,authority exists in the Law and Funds have been budgeted,appropriated and otherwise made available and a <br /> sufficient unencumbered balance thereof remains available for payment in Fund Number 424,Organization YYYY.Appropriation 811, <br /> Program WTRC,Object Code 5120,Contract Encumbrance Number, 6. `/.,2 ;and <br /> WHEREAS,required approval,clearance and coordination have been accomplished from and with appropriate agencies;and <br /> WHEREAS, pursuant to the provisions of section 37-60-122(1)(c), Colorado Revised <br /> Statutes, as amended, the State is authorized to prepare feasibility reports on proposed <br /> water projects; and <br /> WHEREAS, the Contractor was created pursuant to the provisions of section <br /> 37-46-103, Colorado Revised Statutes; and <br /> WHEREAS, the Contractor is authorized pursuant to the provisions of section <br /> 37-46-149 to accept contributions, grants, or loans from the State; and <br /> WHEREAS, the State, acting through the Colorado Water Conservation Board <br /> (CWCB), has advanced One Hundred Thousand Dollars ($100,000) as the State's share <br /> of the Yampa River Basin Alternatives Feasibility Study on the reformulation of the <br /> Contractor's proposed Juniper Cross Mountain Project; and <br /> WHEREAS, the State has been authorized under Section 14 of Chapter 333, Session <br /> Laws of Colorado 1992, to appropriate One Hundred Thousand Dollars ($100,000) as <br /> the State's share of a detailed feasibility study on one of the alternatives proposed in the <br /> Yampa River Basin Alternative Feasibility Study; and <br /> WHEREAS, the Contractor desires to share in the cost of the said detailed <br /> feasibility study and to perform the said study in cooperation with the State, the Bureau <br /> of Reclamation and the Recovery Implementation Program (RIP) for Endangered Fish <br /> Species in the Upper Colorado River Basin; and <br /> 1620E* <br /> Page 1 of 6 pages <br />
