Ground Water Rights Appraisal <br />Page 3 of 8 <br /> <br />March – 2011 – Project #1151TWD03 <br />© Leonard Rice Engineers, Inc. <br />5.0 SCOPE OF VALUATION <br />The appraisal included the following tasks: <br /> Review of Decree 87CW300. <br /> Analysis to confirm the decreed annual appropriation. <br /> Review of the State Engineers Office (SEO) Master Well List to determine general hydrogeologic <br />conditions. <br /> Review of Curt Wells’ letter rep ort of ground water availabilit y associated with the Lambert <br />Property dated January of 1984. <br /> Research recent sales of D enver Basin Ground Water. <br /> Review of the Douglas County Zon ing Resolution Section 18A: Wat er Supply‐ Overlay District <br />(Amended 8/22/07). <br /> Define the neighborhood market. <br /> Consider the highest and best us e for the ground water rights. <br /> Develop an opinion of value. <br />6.0 WATER NEIGHBORHOOD <br />The water neighborhood is defined as the regional setting of th e subject water right. The subject <br />water rights are located within the defined Denver Ground Water Basin. They are designated as <br />nontributary and not‐nontributary ground water and are referred to as the ground water rights. In <br />addition, Douglas County (Zoning Resolution Section 18 A) has c lassified the Ranch area as mostly <br />Margin A Water Supply Zone with a small portion as Margin B Wat er Supply Zone (Figure1), which <br />can only be used in Margin A a nd B Water Supply Zones. <br />7.0 HIGHEST AND BEST USE <br />The highest and best use of the water rights is defined as foll ows: <br />The reasonable probable and legal use of the water, which is physically possible, <br />legally permissible, finically feasible, and that results in the highest value. <br />The not nontributary D enver Aquifer ground water rights are req uired through the decree to obtain <br />a court approved plan of augmentation to replace 4 percent of t he amount of water withdrawn <br />annually in accordance with Colo . Rev. Stat. §37‐90‐137(9) (c) (1991 Supp.). The ground water <br />rights classified as nontributary are required to relinquish 2 percent of the annual amount of <br />ground water withdrawn. <br />The water rights are decreed to be used, reused, successively u sed and otherwise disposed of for all <br />purposes including: municipal, d omestic, industrial, commercial , fire protection, irrigation, stock <br />watering, recreation, fish and wi ldlife purposes, sanitary purp oses, storage, augmentation and
