Emergency Loan Application and Feasibility Study GREEN DITCH COMPANY <br />Project Background <br />During the unprecedented flood of September 2013 in the tributaries to the South Platte River, a <br />significant number of diversion structures and dams along the river corridor were damaged. The <br />Project repair /rehabilitation proposed in this Feasibility Study received significant damage as a <br />result of the flood. <br />The Green Ditch, a diversion from Boulder Creek in Boulder County, was originally <br />appropriated in 1862 and adjudicated in 1882, with a decree of 34.58 cfs. The Ditch irrigates <br />approximately 1300 acres with an average annual flow of approximately 1800 acre feet. During <br />the flood in September 2013, Boulder Creek breached upstream of the ditch headgate and no <br />longer diverts any water to the headgate. <br />Without either repairing the stream bank or creating a new point of diversion for the ditch, none <br />of the shareholders will receive their allocated water and the water rights will be abandoned. <br />The seven shareholders of this ditch include the City of Boulder, ERTL Inc., Mountain Lease <br />Enterprises, Karel and Alice Starek, Gisela Hoffman, and Aaron Kennedy. The water is used to <br />irrigate significant areas of Open Space owned by the City of Boulder, as well as agricultural <br />property preserved under conservation easement by the City of Boulder. Additionally, Mountain <br />Lease Enterprises plans to use its water rights from this ditch to enhance snowmaking operations <br />at Eldora Mountain Resort. The Stareks and the Kennedys maintain small organic farms and <br />Gisela Hoffman owns and operates Peaceful Meadow Resort. The use of these water rights <br />extends far beyond the individual property owners.
