64 active shares in the Box Elder Ditch that operate under three priorities, originally <br />decreed in Civil Action 320 (Case No. CA320) in the District Court, Larimer County, <br />State of Colorado, on April 11, 1882. The Box Elder Ditch headgate is located slightly <br />upstream of the Fossil Creek Reservoir Inlet Ditch headgate and services lands south of <br />the Cache la Poudre River and upstream of the confluence of the Cache la Poudre <br />River and Fossil Creek. The Box Elder Ditch crosses under the Cache la Poudre River <br />and historically served the Three Bells property northwest of the Kyger Reservoir. <br />Water Availability <br />The Box Elder Ditch has historically diverted from April to October, according to records <br />provided by the State. Prior change of use cases have decreed a diversion season of <br />April 1 through October 31, which is consistent with historical operations. <br />Delivery and Consumptive Use <br />Pro-rata river headgate diversion between the years 1950 and 2012 averaged <br />approximately 98.9 acre-feet per share. Appling a ditch loss of 15 percent, pro-rata <br />farm headgate deliveries are 84.1 acre-feet per share. Assuming a farm efficiency of 50 <br />percent, the consumptive use credit is estimated to be 42.0 acre-feet per share. <br />However, compared to the average yield per share from decreed change of use cases, <br />it appears this value is low. The average consumptive use from previous change cases <br />is 47.8 acre-feet per share. For recently decreed change of use cases, the average <br />consumptive use credit is closer to 45 acre-feet per share and this is the value used in <br />this report. <br />11 <br />Data from Decree in Case No. 94CW015, signed November 29, 1995, Applicant was the Swift Gravel <br />Company. <br /> <br />
