CWC9 <br />Mr. Steve Harris, President <br />Animas — La Plata Water Conservancy District <br />P0 Box 475 <br />Durango CO 81302 <br />Re: Durango Pumping Plant Site - Property Conveyance <br />Dear Steve: <br />On May 12, 1998, the Colorado Water Conservation Board authorized the Director of the <br />CWCB; to accept title, in the farm of a quitclaim deed, from the Colorado Department of <br />Public Health and Environment for the 46 acres, more or less, of land located in the West <br />of Section 32, Township 35 North, Range 9 West of the New Mexico Principal <br />Meridian, as more fully described in the deed from the CDPHE to the CWCB. The Board <br />also directed the CWCB staff to convey the property to the Animas - La Plata Water <br />Conservancy District at the earliest possible time, subject to an exception for an easement <br />to the Bureau of Reclamation for the Durango Pumping Plant of the Animas -La Plata <br />Project. <br />The CWCB, the District, and the Bureau will enter into a Memorandum of Agreement <br />(MOA) before an easement is granted to the Bureau The MOA will include a provision <br />whereby the easement to the Bureau will result in a credit to the State of Colorado's $5.6 <br />million obligation for the Animas -La Plata Project. <br />We will keep you advised as to our schedule for accepting the property and conveying it <br />to the District.
