Animas -La Plata Project <br />Feb 13, 2013 Draft Transfer Inspection Report <br />Section 1.13 of Reclamation Manual, Directives and Standards, FAC 01 -05 further defines the transfer <br />process and Reclamation's obligation as follows: <br />"Transfer from Construction Status or Reclamation O &M Status to Water User Organization <br />O &M Status. Reclamation law provides for the transfer of the responsibility for O &M of <br />constructed facilities to water users or other legally authorized organizations. Title to all <br />project works will remain with the United States unless and until the Congress of the United <br />States provides otherwise. The transfer will not preclude later charges to the principal <br />obligation for completions and corrections found necessary and documented during transfer <br />inspections." <br />Reclamation, in cooperation with the Association, will continue to honor its obligation for completion <br />and correction of items identified in this report. Unless otherwise noted, corrective actions identified in <br />Section VI of this report will be funded with Reclamation construction dollars. Reclamation has the <br />ultimate responsibility to ensure that the Transferred Works will operate and function in a manner fully <br />capable of meeting Project requirements. The Association will continue to be fully involved in all <br />aspects of future corrective actions, and is anticipated to continue assisting with reasonable skills and <br />equipment towards these ends. <br />The OM &R responsibility of the Association will be pursuant to the OM &R Contract. The Association <br />shall not be responsible for the management of the following Project features, lands, facility relocations, <br />or appurtenant facilities: <br />• Navajo Nation Municipal Pipeline. <br />• Recreation facilities at Lake Nighthorse. <br />• Mitigation Area and related lands located in the La Plata River Basin. <br />• County Road 211 (now 210), gas lines (relocated), power lines (WAPA). <br />• LPWWA features. <br />• Dam Instrumentation data collection platforms. <br />• And any other facilities as specified between the United States and the Association. <br />0 S EEP E111ENT OF If INI�� <br />U.S. Department of the Interior <br />Bureau of Reclamation <br />
