Contract No. 09 -SLC -0645 <br />Period Allocation (RPA) and Non - Runoff Period Allocation (NRPA) shall be <br />established in Exhibit A and shall be modified from time to time by the Parties in <br />successive revisions of Exhibit A to meet the Contractor's requirements. A <br />revised Exhibit A specifying the RPA and NRPA shall be executed at least <br />45 days prior to each Summer Season. <br />6.4 Authorized Overruns: It is the intent of Western to serve the Contractor's load <br />requirements up to the CROD in each Runoff Period or Non - Runoff Period. <br />Normally, the Contractor will be billed based on the RPA and the NRPA <br />established in Exhibit A. However, if actual deliveries to the Contractor exceed <br />the RPA or NRPA in any billing period, Western shall bill the Contractor for such <br />overruns in that period at the firm power rate specified in the applicable rate <br />schedule. Western may, after consultation with the Contractor, immediately <br />require a revised Exhibit A reflecting the increased RPA or NRPA. The billing <br />demand and actual use will be reconciled at the end of each Runoff Period or <br />Non - Runoff Period, and if necessary, a billing correction shall be made and <br />submitted to the Contractor for payment. If the Contractor's loads consistently <br />exceed the RPA or NRPA in Exhibit A, Exhibit A will be revised to properly <br />reflect the Contractor's actual power requirement during that period. <br />6.5 Designated Point(s) of Delivery and Voltages: Firm electric service furnished by <br />Western to the Contractor will be delivered at Tri -State Generation and <br />Transmission Cooperative's Durango Substation at 115 kV and metered by <br />7 <br />
