Subject: Comments on Annexation of Lake Nighthorse by the City of Durango
Dear Ed:
This letter is to provide the Bureau of Reclamation with La Plata Conservancy District's (LPCD) list of
recommendations that should be negotiated prior to the City of Durango annexing Lake Nighthorse:
1. The City must exempt the Project from complying with Durango's additional layer of regulation
and ordinances, so as not to cause operating expenses to increase unnecessarily and inhibit the
efficient operation of the Project.
2. The City must assume risk responsibility, at least equal to the Association's, for protecting water
quality in the reservoir as a result of their operations.
3. The City must exempt the Project from any City taxes that may be imposed as a result of being "in
the City ".
4. The City must agree that the operation of the Project will take priority over any recreational
considerations now or in the future.
