ALPOM &R issociation <br />November 512012 Board Meeting Minutes <br />(11/20/12 — raft—v2) <br />7. BOR Jpdate <br />Ryan Christianson reported negotiations with the Navajo Nation on the Title Transfer Agreements <br />conti iue and drafting of the two Water Delivery Contacts with the two Colorado Ute Tribes has <br />comr ienced internally. <br />Barry Longwell discussed the status of the DPP Annexation and reported when construction on the <br />Durai igo Pumping Plant began in 2004 the project required a source for water and sewer service and <br />the o fly source was the City of Durango which required the Animas La Plata Water Conservancy District <br />to en er into an Implied Consent Agreement with the City of Durango. One of the conditions of the <br />Agref ment was that should the DPP property ever become eligible for annexation; the property owner <br />wouli I request annexation. In 2009 the City of Durango determined the property was eligible for <br />anne ation and the City Council voted for annexation but the process was delayed due to mapping <br />issue between the City and County regarding County Road 210. Because the road is un- plated and <br />they Vo not have to annex CR 210, the City is now in a position to move forward with the annexation <br />procE ss. Barry said he would forward an email from Craig Rosser of the City Planning and copies of the <br />2009 Annexation Agreement to the Association Board in order to provide the Association and individual <br />spon ors the opportunity to review and comment on the DPP Annexation Agreement. The City has <br />indici ited they have comments and adjustments to the plat map. Barry requested comments from the <br />Asso iation, and each member entity, on the Annexation Agreement which does include the full 46 <br />acres The Board agreed to review the DPP Annexation Agreement and discuss it at the next <br />Asso iation Board meeting on December 3rd. <br />Barri Longwell distributed a prioritized list of close -out items and their status and which includes <br />com ents by WACO. <br />8. ADDIRIONAL DISCUSSION <br />Kathl en Ozga further discussed the Preliminary Draft Environmental Assessment Lake Nighthorse <br />Recrf ation Master Plan and requested comments from the Association so they can be incorporated <br />into t ie Plan prior to the 30 -day public review period. The Association agreed to submit comments on <br />the E k by Friday November 16, 2012. Russ Howard will forward comments to Board members <br />high) ghting his concerns about the document. There was a discussion that the EA incorporates various <br />alter iatives and confirmed that the Plan does not designate a specific recreation management <br />orgar ization. Mark Chiarito stated the Association's comments and /or individual member sponsor's <br />comr ients would also be welcome during the 30 -day public review period. The Board agreed to funnel <br />Asso iation comments to the BOR via Russ Howard. Sponsors also agreed that their comments made <br />direc Ily to the BOR regarding the EA Plan would also be sent to Association staff. <br />Ryan rhristianson reminded the Association Board that comments on the Fish Escapement report are <br />also ue on Friday November 16, 2012. <br />The <br />Kirkpatrick made a motion to adjourn the meeting.
