ALPOM &R Association <br />October 8, 2012 Board Meeting Minutes <br />(10/10/12 v2 — Draft) <br />balanced test of the jet flow gate (emergency release gate) which released about .7 of with flows that <br />reached about 250 cfs or 10% of the jet flow gate capacity. Carly DeLong reported that acquiring <br />insurance coverage continues to be challenging due to the nature of the project, however, Rene Larricq <br />of Leavitt Group Agency Association, LLC has secured the following policy options and annual <br />premiums: Slip and Fall /Premise Liability $3,835.72, Inland Marine $2,700, and Commercial Property <br />$740. Rene is making every effort to obtain a quote for a $2 million umbrella policy and a rider for <br />Director's and Officer's coverage and we are expecting a second set of quotes from another broker. In <br />any event, staff will move forward and purchase insurance in the next week or two. <br />7. BOR Update <br />Ryan Christianson reported a new draft of the Fish Escapement Report was received from Denver and it <br />incorporates all of the BOR comments. The Association requested a copy of the report with adequate <br />time to review it and make comments. Ryan further reported they are working on an amendment to <br />extend the time frame on the escrow instructions for the funding agreement with the Colorado Water <br />Resources and Power Development Authority. Ryan announced the WACO has relocated to a new <br />office. <br />Barry Longwell reported $1.826 million of discretionary funds have been moved into the construction <br />funding account for ALP and he continues to pursue $400,000 in ARRA Funds. The BOR is in the <br />procurement process of the lower cost 8' chain link fence for installation around the baseball field <br />keeping the Association's security concerns in mind. The equipment storage building is now in the <br />procurement process. The BOR is working with Association staff on the design of the 3 remaining <br />punch list items which are the silt removal system in the front of the fish sweeps, the security gate at <br />the end of the by -pass and the air chamber piping. Also, the BOR is moving forward on the crest gate <br />fix. From Barry's perspective the remaining critical item regarding the Transfer is the Agreement for an <br />escrow account to hold funds set aside for future pump rebuilds to address the coatings failure. Barry <br />hopes to have something to distribute to the Association's Board for review in the next few weeks. <br />It was discussed and agreed that the Association would meet for a Work Session once the Transfer <br />Report and the Deferred Funding Agreement are received from the BOR for review. <br />Steve Dunn made a motion to adjourn the meeting and enter into an Executive Session at 1:46 PM. <br />Lena Atencio seconded the motion. Voting yea were: Aaron Chavez, Lena Atencio, Jason John, Mike <br />Brod, Steve Dunn and Celine Hawkins. The motion passed. Manual Heart left early. <br />Mike Brod, attending via conference call, left the meeting at 1:47 PM <br />Steve Dunn made a motion to adjourn the Executive Session. Aaron Chavez seconded the motion. <br />Voting yea were: Aaron Chavez, Lena Atencio, Jason John, Steve Dunn and Celine Hawkins.
