ALPOMBR Association <br />October 8, 2012 Board Meeting Minutes <br />(10/10/12 v2 — Draft) <br />Manual Heart recommended two people review the images and present recommendations to the <br />Association Board for consideration as art decor in the ALP office building. Steve Dunn recommended <br />Charles Blassingame be one of the representatives selected to review and present selected assets. <br />S. Status of Discussions with SWCD <br />Aaron Chavez made a motion at 11:05 AM to go into Executive Session. Steve Dunn seconded the <br />motion. Voting yea were: Aaron Chavez, Steve Dunn, Manuel Heart, Lena Atencio, Mike Brod and <br />Jason John. The motion passed. <br />The Executive Session ended at 12:20 PM <br />6. Lunch The regular meeting reconvened at 12:51 PM <br />7. Discussion on CWCB Letter <br />Discussion was opened and it was acknowledged the letter dated September 15, 2012 from Jennifer <br />Gimbel, Director of the Colorado Water Conservation Board, satisfied any remaining member's <br />concerns regarding CWCB's membership into the Association. <br />Mike Brod made a motion to accept the Colorado Water Conservation Board into the membership <br />of the Animas La Plata Operation, Maintenance and Replacement Association, effective <br />immediately. Aaron Chavez seconded the motion. Voting yea were: Aaron Chavez, Steve Dunn, <br />Manuel Heart, Lena Atencio, Mike Brod and Jason John. The motion passed. <br />8. Annexation of Reservoir <br />The City of Durango is seeking annexation of the reservoir from the BOR. Russ Howard reported that <br />the Association, as a whole, would be impacted minimally if the reservoir were annexed and could even <br />benefit by improved law enforcement coverage resulting from the annexation. Also, the Association <br />can request the BOR incorporate language in the annexation agreement that protects the Project's <br />features as a Federal project against negative impacts to the Association instituted by the annexation. <br />However, there could be a direct impact to the Association's individual member entities; individual <br />member entities would not be protected by the BOR's interpretation of Project features for future <br />build -out and member entities would be required to abide by City ordinances, building codes, etcetera. <br />The BOR has assured Russ that each member entity will be consulted by the BOR on this issue because <br />it has direct implications to the future plans of the member entities. Ryan Christianson will reiterate to <br />Ed Warner the need for the BOR to contact each Association member entity individually. Russ also <br />reported that annexation would expose the Association to a potential L.P.E.A. franchise fee on the <br />Ridges Basin Dam electric meters. However the projected exposure, if the franchise fee is re- enacted, <br />would be minimal at 4.67% or approximately $50 per month. <br />9. Staff Report <br />Russ Howard reported: an additional 50,000 trout were stocked in Lake Nighthorse since the last Board <br />meeting and Dam Tender Training occurred. Dam Tender Training included very beneficial and <br />informative class room and Ridges Basin Dam site - specific training. Aaron Chavez acknowledged the <br />benefit of the training and recognized Russ and staff who have an advanced and thorough <br />understanding of the project.
