A <br />Gener, ly under an assignment a person or entity transfers to another the whole of his/her or its right, <br />interes or property. Here, the Assignment states that the easement assigned to the United States is <br />"subje t to all reservations in the Deed," meaning the reservations to CDHPE and to CWCB. Moreover, <br />the ass gnment imposes a variety of covenants on the United States that serve to protect CWCB's and <br />CDHPI 71S respective interests and that "shall be enforceable by the CWCB and CDPHE." Consequently, <br />even 1tion ugh it assigned an easement to the United States, this language shows that the State still holds its <br />reserperpetual easement covering the 46.27 acres, and that the State did not relinquish its easement <br />when Assignment was executed. In short, the State assigned an easement on its easement that it <br />contin s to hold. Therefore, when the Assignment is amended to reflect Reclamation's final footprint, <br />Recla will release to the State the easement acreage not needed for operation and maintenance of <br />the D <br />The Ur ited States agreed to provide the State through the CWCB credit for the 46.27 acres which would <br />be appl ed towards the State costs for construction of the Animas -La Plata Project. However, that credit <br />amount will need to be reduced by the easement acreage that Reclamation will release back to the State. <br />To that end, the easement will need to be appraised pursuant to the Uniform Appraisal Standards for <br />Federal Land Acquisitions, also known as the "Yellow Book ".
