Whitehead and Feehan: <br />Thank you for meeting with us on December 3, 2012, to discuss the Durango Pumping Plant (DPP) <br />permanent operating easement. As a result of the meeting, we would like to provide a summary of what <br />is involved with crediting the State of Colorado (State) for the easement that it conveyed by an <br />assignment to the Bureau of Reclamation in 2002 and also what needs to occur to eventually define the <br />final easement area for the DPP. <br />As you know, the State through the Colorado Department of Public Health and Environment (CDPHE) <br />obtained title to 46.27 acres of land in August of 1990. On June 25, 1998, the CDPHE conveyed the land <br />to the Colorado Water Conservation Board (CWCB). Subsequently, the CWCB conveyed the land via <br />Quit Claim Deed (Deed) to the Animas -La Plata Water Conservancy District on August 21, 1998. In the <br />Deed, the CWCB reserved "to itself and its assigns a perpetual easement over that portion of the property <br />reasonably necessary for the construction, operation, maintenance and replacement of the Durango <br />Pumping Plant." On October 10, 2002 the State through the CWCB assigned to the United States through <br />Reclamation "a perpetual easement over that portion of the Property reasonably necessary for the <br />construction, operation, maintenance, and replacement of the Durango Pumping Plant of the Animas -La <br />Plata Project." The assignment of easement document (Assignment) is enclosed for reference. <br />The entire parcel was assigned to Reclamation to allow the greatest amount of flexibility contractually for <br />Reclamation to work with its contractors and provide a generous unrestricted work area. Reclamation <br />was to determine the exact location and area of the said easement, based on plans and specifications for <br />the DPP, by December 31, 2008. However, the December 2008 date slipped due to ongoing construction <br />activities. At this time, construction for the DPP has been completed and Reclamation is currently <br />determining the amount of land that will be needed for long-term operation, maintenance and replacement <br />purposes. <br />
