A <br />COMMENTS OF CENTRAL NEBRASKA PUBLIC POWER AND <br />IRRIGATION DISTRICT <br />alternatives anticipate good faith negotiations toward a <br />Basin -Wide Recovery Implementation Program, and execution of <br />certain interim measures.H' The interim measures are based <br />on the Colorado projects contributing a proportional share <br />of DOI's current basin -wide land and water enhancement <br />recommendations.0 The MOA requires similar treatment of <br />other projects.D' To determine what constitutes a <br />proportional share, DOI has used a formula to calculate each <br />projects' proportional share of total depletions in the <br />basin. Based on DOI's methodology for determining <br />H' DOI, Front Range Opinion, attached as Vol. 2, Ch. X, <br />App. X -E. <br />The term "interim measures" is a misnomer here since <br />these measures are interim only if a Basin -Wide Recovery <br />Implementation Plan is successfully negotiated and the <br />provisions of that plan change them. If there is no <br />successfully negotiated plan, the 'interim, measures stand <br />for the life of the permit sought. The interim measures <br />were calculated as if they were permanent for 20 years. <br />IF E.a., jsL The current basin -wide land and water <br />needs upon which these opinions are predicated are the <br />PRMJS, Habitat Conservation Program and the recent basin - <br />wide flow recommendations released by DOI.
