III. <br />June 30, 1997 <br />DEFINITIONS OF TERMS AND RELATIONSHIPS WITH OTHER <br />DOCUMENTS <br />A. Cooperative Agreement. The Cooperative Agreement is that agreement among <br />DOI and the States of Colorado, Nebraska and Wyoming anticipated to be signed <br />pursuant to the Memorandum of Agreement among those parties for the purposes of: <br />putting forward a proposed basin -wide Platte River Recovery Implementation Program <br />Alternative ( "Proposed Alternative "); undertaking the study and planning activities <br />necessary to finalize a Platte River Recovery Implementation Program ( "Program ") <br />following review pursuant to the National Environmental Policy Act and the ESA; <br />implementing certain activities which would be beneficial to endangered species <br />pending finalization of the Program; and establishing a governance structure for <br />carrying out activities under the Cooperative Agreement and subsequent Program. The <br />anticipated duration of the Cooperative Agreement is approximately three years. <br />B. Platte River Recovery Implementation Program. The Cooperative <br />Agreement is expected to put forward a Proposed Platte River Recovery <br />Implementation Program Alternative. The Program, if adopted, will be a basin -wide <br />program among the three states and DOI intended to: implement certain aspects of the <br />FWS's recovery plans for certain target species (whooping cranes, interior least terns, <br />piping plovers and pallid sturgeon) in order to secure defined benefits for those species <br />and their associated habitats, as defined in the Cooperative Agreement, so as to assist in <br />their conservation and recovery; serve as the reasonable and prudent alternative to the <br />effects of water - related activities in the Platte River Basin that, in the absence of such a <br />Program, could be found by DOI and federal action agencies to jeopardize the <br />continued existence of target species or adversely modify designated critical habitat; <br />and to help prevent the need to list more basin - associated species pursuant to the ESA. <br />C. Governance Committee. The Governance Committee is that committee <br />designated in the Cooperative Agreement, or its successor governance body as it may <br />be structured under the Program. <br />D. Habitat <br />1. Habitat Lands are those lands to be set aside and managed for wildlife in <br />accordance with Paragraphs IV.A.2 to IV.A.6 of this Agreement in Principle. <br />2. Program Habitat Lands are those Habitat Lands which are also <br />designated by the Governance Committee as part of a land component of the <br />Program. <br />1wa <br />
