AGREEMENT ON TRANSMISSION LINES <br />Nebraska Public Power District (NPPD) agrees to the following measures with respect to certain <br />NPPD -owned transmission lines: <br />1. Within six months from the date of this Agreement, NPPD will provide to the U.S. <br />Fish & Wildlife Service ( USFWS) a map showing the location of NPPD -owned <br />transmission lines 34.5 kV and above located within one mile of the North Platte and <br />Platte Rivers between Kingsley Dam and Chapman, Nebraska, and the location of <br />confirmed whooping crane sightings documented in the last twenty years within one <br />mile of those Iines except for sightings within incorporated communities and other <br />residential or industrial areas. Also, NPPD will 1) meet with the USFWS to review <br />and evaluate the mapping and sighting information; 2) work with the USFWS to <br />evaluate the site - specific merits of marking any NPPD lines; 3) take this USFWS <br />information and other pertinent information into consideration; and 4) proceed in a <br />reasonable and prudent manner to mark NPPD transmission lines where such marking <br />is warranted to reduce the likelihood for a collision with a whooping crane. <br />2. Prior to the development of any new transmission lines (34.5 kV and above) located <br />within one mile of the North Platte and Platte Rivers between Kingsley Dam and <br />Chapman, Nebraska, NPPD will consult with the USFWS to determine whether the <br />lines are likely to pose a hazard for whooping cranes and if so, whether they can <br />reasonably be designed and constructed to reduce the likelihood of impact by <br />whooping cranes. <br />3. This Agreement on transmission lines will not become part of any new Federal Energy <br />Regulatory Commission (FERC) license since the transmission lines are not subject <br />to the licensing jurisdiction of FERC. If for any reason FERC imposes license <br />conditions relating to the marking of NPPD transmission lines, this Agreement will <br />be null and void. Otherwise, this Agreement will continue for 20 years and thereafter <br />until terminated by the written notice of either NPPD or the USFWS. <br />
