C <br />June 30, 1997 ' <br />b. Program Terminates or Is not Adopted I <br />Notwithstanding any of the above provisions, if the Program is not <br />adopted and implemented at the end of the term of the Cooperative <br />Agreement or if the Program is later terminated: <br />' <br />() FWS will request q uest reinitiation of consultation with FERC <br />when and as described in the Cooperative Agreement, Paragraphs <br />II and VIII, and the Proposed Alternative, pages 1 -2 and <br />' <br />Paragraph IV. The agreement for the Districts to take the actions <br />described below does not preclude FWS from seeking to modify <br />those actions in a reinitiated consultation. FWS agrees that if any <br />, <br />reinitiation of section 7 consultation is necessary, it shall prepare <br />a new Biological Opinion reflecting then - current conditions. <br />' <br />(2) The Districts will continue to operate and manage water in <br />accordance with the provisions of the agreed to water plan as ' <br />described in An Environmental Account for Storage Reservoir on <br />the Platte Rivers in Nebraska (with the following necessary , <br />modifications reassigning Program functions) until that plan may <br />be revised in the FERC license, if necessary. <br />(a) The Districts will continue to pass through or ' <br />accept contributions to the Environmental Account of New <br />Water from reregulation projects or water ' <br />conservation/supply projects approved by the Governance <br />Committee before the Program was terminated, if they <br />continue to be operated in the manner approved through a ' <br />Program, and if the Districts and the entity providing <br />water modify or enter into contracts as necessary for the <br />Districts to store the water and to receive a reasonable fee. I <br />(b) NEDWR will assume Program responsibility for <br />accounting for contributions to the Environmental <br />Account, including monitoring intended to confirm the <br />continued receipt of New Water, and that the Current ' <br />Regime of the River is not altered in a manner <br />inconsistent with earlier Program approvals. Procedures <br />and accounting practices developed under the Cooperative ' <br />Agreement or Program will be used to the extent possible. <br />-22- � <br />
