The parties agree that it is not necessary to have a license ' <br />condition in either license, or a provision in Central's plan or plans, to <br />address: , <br />(1) Protection of Sutherland Canal trout habitat by installation <br />of gates, dams, or other structures. ' <br />(2) Construction of eagle perches. <br />' <br />(3) Extensive fencing of the south shore of Lake McConaughy <br />or purchase of land to facilitate such fencing. <br />' <br />(4) DOI will not, at this time, request further requirements to <br />monitor DO and aerate releases into Lake Ogallala, as such <br />, <br />requirements have already been imposed through the Clean Water <br />Act section 401 certification and the regulations of the Nebraska <br />Department of Environmental Quality, and the Districts have <br />' <br />programs already in place.. <br />(5) Nesting boxes/ game bird surveys <br />' <br />(6) Developing a canoe trail on Central's Supply Canal <br />' <br />2. Public Education Programs. The Districts will continue to participate in <br />public education programs such as eagle viewing. The parties agree that <br />, <br />building an improved visitor center should not be a license condition. <br />3. Cultural Resources. The Districts will participate in the development of ' <br />Programmatic Agreements between FERC and the historical preservation <br />agencies (National Parks Service and the State Historic Preservation Officer). <br />DOI will participate in such proceedings if necessary to help assure that any , <br />requirements resulting from this Program do not impinge on the Districts' <br />ability to comply with the water operations, water conservation and land <br />management components of this agreement and the Program. ' <br />Other I <br />1. Serving amendment requests on DOI. As recommended by DOI, the <br />Districts agree to file any future FERC license amendment requests with DOI's <br />attorney of record, and the FWS Regional and Grand Island Offices. <br />
