Fa <br />June 30, 1997 ' <br />or involving District irrigators, which are included in the Milestones for ' <br />the Cooperative Agreement or later Program Milestones. <br />C. The Districts may voluntarily take the lead in carrying out ' <br />conservation programs and projects, but will not be required to do so. <br />The Districts may be compensated through Program funding for such ' <br />voluntary efforts. <br />System Water Management ' <br />a. Irrigation Water Use. DOI and NGPC proposed caps on ' <br />irrigation acreage; the parties agree that the Districts' ability to contract <br />to deliver to new or different lands shall be limited only as follows: <br />(1) Except as described in item (2) below, through the next <br />license term there will be no increase in the volume of water used <br />by the Districts' irrigation customers. Compliance with that ' <br />commitment is measured as follows: <br />(a) Neither Central, NPPD, nor their irrigation , <br />customers collectively, will have an increase in the water <br />volume covered by irrigation storage use permits beyond ' <br />the volume these irrigators have a right to as of the date of <br />relicensing. This means: (i) there is no limit on the <br />ability to transfer water rights among lands in areas served ' <br />by the Districts; and (ii) if water rights for lands served by <br />the Districts are abandoned, adjudicated away or <br />otherwise terminated or reduced in quantity, the Districts ' <br />may replace these former customers with lands granted <br />new water rights, up to the quantity of the water rights <br />that were terminated. I <br />(b) In future irrigation seasons, Central will not <br />provide more water for irrigation at the headgates of the ' <br />E -65, E -67 and Phelps canals than the maximum quantity <br />of water historically diverted into those canals during the <br />irrigation season. Irrigation season diversions directly ' <br />from the Supply Canal and into the E -65, E -67 and Phelps <br />Canals will collectively be no more than 357,743 acre feet ' <br />in any year, except as may be required by state law.
