amounts claimed herein; continuation of the Clear Creek trail system along the Course <br />Extension; installation of slalom gates in the Course; hosting local, national, and international <br />boating events on the Course and Course Extension; defense of the City of Golden's water rights <br />including the Course and Course Extension rights; and defense of the Supreme Court appeal of <br />the Course and Course Extension water rights. These actions demonstrate reasonable diligence <br />with respect to the subject conditional water rights. <br />9. Decree of the Court. The foregoing paragraphs, including teams and conditions and <br />the stipulations filed in this case between the City of Golden and the CWCB, the City of <br />Northglenn, and the City of Westminster, are fully and completely incorporated into and made a <br />part of this Decree. The Court finds and orders that the City of Golden has satisfied all necessary <br />legal prerequisites and hereby orders that (1) through reasonable diligence and application of its <br />conditional water rights to beneficial use, the City of Golden has made absolute a portion of its <br />conditional water rights for the structures constituting the Course, and maintained the remainder <br />of its conditional water rights, as set forth in Tables 5 and 6; (2) through reasonable diligence and <br />application of its conditional water rights to beneficial use, the City of Golden has made absolute <br />a portion of its conditional water rights for the structures constituting the Course Extension, and <br />maintained the remainder of its conditional water rights, as set forth in Tables 7 and 8; and (3) <br />through reasonable diligence the City of Golden has maintained its conditional water rights for <br />the 3 structures of the Course Extension not yet built. <br />An application for Sextennial Finding of Reasonable Diligence shall be filed on or before <br />the last day of 2014, if the City of Golden wishes to maintain its conditional water <br />rights, or a showing made on or before said date that the conditional rights have been made <br />absolute by completion of the appropriation. <br />It is accordingly ORDERED that this ruling shall be filed with the Water Cleric subject to <br />judicial review. <br />It is further ORDERED that a copy of this ruling shall be filed with the appropriate Division <br />Engineer and State Engineer. <br />Dated this day of , 2008. <br />BY THE COURT: <br />Hon.
