GOLDEN, CO 80401
FAX: 303-384-8161
•4vw,A,.dtyofgo1den.net
RECEIVED
INEME7
When the CWCB filed its statement of opposition to Golden's diligence
application for its whitewater park, we were assured that the Board would not unduly
delay this case. The CWCB indicated that it merely wished to verify flow rates during
actual course usage.
We have provided to your attorneys the enclosed unrebutted evidence of the flow
rates during course usage, and the enclosed stipulation that contains the no precedent
language requested by your attorneys. Notwithstanding, the CWCB has delayed
finalizing a settlement and Golden is now going to have to spend money to prepare expert
witness reports. In this time of fiscal constraints, there is no justification for the CWCB
to cause the needless expenditure of municipal funds.
All of the other objectors in this case have long ago withdrawn their opposition
and quickly settled after we provided the enclosed evidence. We ask that the CWCB do
the same as your attorneys have not articulated a basis for the CWCB's continued
opposition.
Ver truly yours,
ZZ 6L-7t—
Dan Hartman
