ARTICLE IX —GENERAL AUTHORIZATIONS <br />SECTION 1- Ditch construction must be on private property with proper written authorization, from <br />each person or persons whose property it crosses. <br />SECTION 2 - All members are responsible for the maintenance, burning weeds and keeping ditch <br />banks clean along their own property. <br />SECTION 3 - All members are responsible infor keeping ditch maintained from the canal to I Road, <br />including burning weeds, spraying weeds, cleaning and keeping boxes free of trash. <br />SECTION 4 - Headgate will be regulated in accordance with the wishes of the members in agreement <br />with the Grand Valley Canal Company. <br />SECTION 5 - Where the ditch is fenced into private property — the landowner is responsible for the <br />breakage and repairs and cleaning. <br />SECTION 6 - No repairs will be made on the ditch with the expectations of receiving Company Funds, <br />unless first approved by the Lateral Executive Board, before repairs are made. <br />SECTION 7 - All members are responsible for participating in the spring and summer ditch cleaning, <br />and for keeping the lateral maintained from its beginning at the headgate on the canal <br />to the end of the lateral. Notices for spring and summer ditch cleaning will be mailed <br />out in advance to all members. Any member not present (or not represented) at the <br />spring or summer cleaning will be assessed a $50.00 fee. <br />ARTICLE X ISSUANCE OF LATERAL SHARES <br />SECTION 1- This Article gives the Board of Directors of Twenty Two Road Lateral Company the <br />authority to issue shares in the Twenty Two Road Lateral Company. Such shares are to <br />be exchanged 1 for 1 for Grand Valley Irrigation Company (GVIC) shares owned by <br />lateral members that have shares assigned to the Lateral's head gate. Such GVIC shares <br />then become the property of Twenty Two Road Lateral Company. <br />SECTION 2 - GVIC shares owned by the Twenty Two Road Lateral Company may only be used for <br />collateral in securing financing and loans from the Colorado Water Conservation Board <br />(CWCB) for the replacement of Twenty Two Road Lateral's open ditch with a buried pipe <br />system. <br />SECTION 3 - Twenty Two Road Lateral Company shares will be held in custody of the Lateral <br />Company in a secure location. Member will be provided with a notice stating the <br />number of Twenty Two Road Lateral Company shares they own. <br />SECTION 4 - Twenty Two Road Lateral Company Shares will continue at least for the life of any <br />outstanding CWCB loans made to the Lateral until such loans are paid off or collateral is <br />no longer needed. <br />4 <br />
