TRANSFERS OF WATER IN THE WEST <br />Work to date: The Council and its staff have followed trends involving water transfers in the <br />West for many years. Staff reports have been prepared on different aspects of intrastate transfers, <br />and the difficulties involved with interstate and interbasin, as well as interregional and <br />international water transfers. Staff also contributed to a National Research Council report on <br />transfers. In 1988, the Department of Interior released a policy on transfers in part in response to <br />a request by the Western Governors' Association. Interior and the Bureau of Reclamation are <br />now reviewing that policy. <br />1998: The Council will assist Interior in its review of its current policy with respect to water <br />transfers and prepare a report outlining related state experiences, interests, laws and procedures. <br />Subcommittee: Mike Turnipseed, Chair, Hal Simpson, Steve Sanders, Ken Slattery, Jeff Fassett <br />Estimated Work Days: 25 <br />Time Frame: January - August <br />6. FERC HYDROPOWER LICENSING <br />Work to date: In the past, the Council has actively undertaken or supported various <br />administrative, legislative and judicial efforts to define a reasonable division of responsibilities <br />for regulating hydropower development in the West between state water agencies and the Federal <br />Energy Regulatory Commission (FERC). The Council's efforts to promote the states as the <br />logical level of government to retain primary responsibility for regulating water for all uses, <br />including hydropower, have met with mixed success. However, they have led to a better <br />understanding of state and federal regulatory processes. <br />The Council and the WGA have opposed amendments to the Clean Water Act to weaken <br />the scope of state authority over proposed hydropower and other projects under Section 401. <br />1998: The Committee will continue to advocate states' rights as part of the federal regulatory <br />process involving hydropower development.
