A summary of the issues and the action items from that <br />meeting follow: <br />4A1 &2 Contradiction concerning Permanent Pool evaporation assessment and <br />alternative sources of water to replace evaporation <br />• This issue was assigned to the Engineering Committee 5/02 <br />4B1 &2 Winter Water Account of convenience and timely distribution of 35% <br />storage charge <br />• Kansas requested to review and comment on Colorado's 5/02 draft <br />resolution to address these issues <br />4B3 Criteria for determining storage of Section III vs. Compact water <br />• Kansas committed to determine if changes to proposed alternative <br />accounting procedure have been made to respond to Colorado's <br />previous criticisms. <br />• Kansas was requested to consider whether the comparison of current <br />conservation storage to that of the 1950 -1975 period required of the <br />Operations Secretary by paragraph 8. J. of the Colorado Water Court <br />decree entered in case 84CW 179 provides .significant reassurance <br />concerning the determinations being made. <br />4C1 Appropriate determination of transit loss under Section II (E)(4) <br />• Kansas requested to review and comment on "Evaluation of Kansas <br />Article II Deliveries from John Martin Reservoir to Stateline (1980- <br />2002) prepared by Thomas W. Ley, PE, PhD presented to Kansas <br />5/03 <br />e ti 4C2 Appropriate accounting procedure to be used in settlement for deficit in <br />delivery of Article lI to Kansas <br />• Colorado to clarify position of Operations Secretary in matrix <br />• Kansas was reminded of its 5/02 commitment to provide a proposed <br />clarifying resolution on this issue. <br />4D2 Non - reporting of Section II(C)(1) determination <br />• Kansas agreed to verify whither or not . an incident of inappropriate <br />temporary storage or averaging of flows is alleged in 2002 <br />4E1 &2 Interrupted transfers from conservation storage to accounts <br />• Colorado to clarify its position in matrix <br />• Kansas to provide a principled basis for this concern <br />On July 15, 2003 the Operations Secretary provided clarifications concerning the positions <br />included in the matrix for those issues indicated above. These changes appear in blue in the <br />attachment. <br />The second meeting was held on August 7, 2003. At this meeting the following transpired with <br />respect to the issues: <br />
