91 SECTION 18. Restoration of emergency infrastructure repair loan <br />2 fund balance. The State Treasurer shall transfer a total of two million dollars <br />3 ($2,000,000), or so much thereof as.may be necessary, from the unreserved cash in <br />4 the Colorado water conservation board construction fund to the emergency <br />5 infrastructure repair loan fund in order to restore the balance in the emergency <br />6 infrastructure repair fund to two million dollars. ($2,000,000). <br />7 <br />8 SECTION 19. Restoration of flood response fund balance. The State <br />9 Treasurer shall transfer a total of one hundred fifty thousand dollars ($150,000), or so <br />10 -much thereof as may be necessary, from the unreserved cash in the Colorado water <br />11 conservation board construction fund to the flood response fund in order to restore <br />12 the balance in the flood response fund to one hundred fifty thousand dollars <br />13 ($150,000): <br />14 <br />15 SECTION 20. Use of litigation fund.- authorization <br />16 37 -60 -121 (2.5) is amended to read: <br />17 (2.5) (a) The board is authorized to expend, pursuant to continuous <br />18 appropriation and subject to the requirements of paragraph (b) of this subsection <br />19 (2.5), a total sum not to exceed f6tif ffifflion della-fs THE BALANCE OF THE <br />20 FUND from the litigation fund, which is hereby created, for the purpose of <br />loi ENGAGING IN litigation OR PARTICIPATING IN ACTIVITIES ASSOCIATED <br />22 WITH FEDERAL OR STATE REGULATORY PROCESSES THAT MAY <br />23 AFFECT THE WATER INTERESTS OF THE STATE AND ITS WATER USERS. <br />24 EXPENDITURES SHALL BE MADE UNDER THIS SUBSECTION (2.5): <br />25 (I) In support of water users whose water supply yield is or may be diminished <br />26 or the cost of said yield is or may be materially increased as a result of conditions <br />27 imposed or which may be imposed, including but not limited to by -pass flows, by <br />28 any agency of the United States on permits for existing or reconstructed water <br />29 facilities located on federally owned lands; or <br />30 (II) To oppose an application of a federal agency for an in- stream flow right <br />31 that is not in compliance with Colorado law for establishing in- stream flow rights.; <br />32 OR, <br />33 (III) TO DEFEND AND PROTECT COLORADO'S ALLOCATIONS OF <br />34 WATER IN INTERSTATE STREAMS AND RIVERS. <br />35 (IV) TO ENSURE THE MAXIMUM BENFICIAL USE OF WATER FOR <br />36 PRESENT AND FUTURE GENERATIONS BY ADDRESSING IMPORTANT <br />37 QUESTIONS OF LAW OR THE IMPACT OF REGULATIONS. <br />38 (b) Pursuant to the spending authority set forth in paragraph (a) of this <br />39 subsection (2.5), moneys may be expended from the litigation fund at the discretion <br />Wof the board if: <br />
