DRAFT <br />AGREEMENT <br />BETWEEN <br />THE CENTRAL NEBRASKA PUBLIC POWER AND IRRIGATION DISTRICT <br />(CNPPID) <br />AND <br />PLATTE RIVER RECOVERY IMPLEMENTATION PROGRAM (PRRIP) <br />CONCERNING <br />FEASIBILITY ANALYSIS OF CNPPID REGULATING RESERVOIRS <br />February 25, 2010 <br />A. Introduction <br />1. The PRRIP has completed a pre - feasibility study of the potential for reservoirs near the <br />J -2 return to the river and of Elwood Reservoir (currently in draft format). <br />2. The PRRIP and CNPPID (collectively parties) wish to cooperate on investigations of the <br />technical and economic feasibility of one or more new reservoir(s) or revisions to existing <br />reservoirs on or near Central facilities. <br />3. The aspects of interest for one or both parties for investigation at the feasibility level <br />include: <br />a. Utilization of potential reservoirs to provide capacity to regulate Program water. <br />b. Utilization of potential reservoirs to regulate releases from the J -2 hydro. <br />4. It is anticipated that CNPPID would own and operate any proposed project found <br />feasible and implemented as a result of this study. <br />5. Other parties interested in this feasibility study may be added through a similar <br />agreement among those parties and CNPPID and PRRIP. <br />6. Neither PRRIP nor CNPPID are bound by this agreement to proceed any further than <br />the initial extended feasibility studies described subsequently in this document. <br />7. The purpose of this document is to outline the expectations and responsibilities of <br />the CNPPID and the PRRIP in this feasibility study. <br />B. Feasibility Studies Analysis <br />1. These investigations will be pursued by PRRIP through cooperation with CNPPID <br />using the consultants and contractors previously selected and retained by PRRIP. <br />2. The feasibility study will include detailed survey and mapping, detail geotechnical <br />investigations, cultural resources investigations, and permitting and environmental <br />. mitigation investigations. <br />
