Form 6- A(' -02A <br />D 'MENT OR AGENCY NUMBER <br />34 -04 -00 <br />CONTRACT ROUTING NUMBER <br />CONTRACT $300,000 <br />THIS CONTRACT, made this 1 s t day of _ N o v e m b P r 198-0, by and between the <br />State of Colorado for the use and benefit of the Department of ' Na t u r a l R P R n„ r c e R <br />_(Colorado Water Conservation Board) <br />hereinafter referred to as the State, and .2 C i tv of R; f i A_ n n n-- , mo n o <br />hereinafter referred to as the contractor <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains ava aWe for nt in Fund Number 4 0 0 8 <br />G/L Account Number 5 3 16 xContrac( Encumbrance Numbe '3 3_1 and <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, '3 pursuant to the provisions of 37 -60 -119, Colorado Revised <br />Statutes 1.973, as amended, the State is authorized to construct certain <br />water projects for the benefit of the people of the State; and <br />WHEREAS, the Contractor is a city in the State of Colorado and <br />wishes to complete construction of its water supply system, herein- <br />after called the project, for the citizens of the City of Rifle in <br />Garfield County, Colorado, at an estimated cost of Three Hundred <br />Thousand Dollars ($300,000); and <br />WHEREAS, a feasibility investigation of said project was conducted <br />and it was found that such a project_,gi0l&economically feasible; and <br />WHEREAS, the State has agreed st t said project and to <br />sell the same to the Contracto, mu greeable terms and <br />conditions, subject to the appr o riations for that <br />purpose by the Colorado General ss d the Governor of the <br />State of Colorado; and <br />WHEREAS, pursuant to Senate 1 No. 67, Fifty- Second General <br />Assembly of the State of Colorado, duly enacted by the Colorado <br />General Assembly and approved by the Governor of the State of <br />Colorado, there was appropriated to the Colorado Water Conservation <br />Board, the sum of Three Hundred Thousand Dollars ($300,000) for <br />construction of the Rifle Project; <br />NOW THEREFORE, in consideration of the mutual and dependent <br />covenants herein contained, it is agreed by the parties hereto as <br />follows: <br />A. The Contractor agrees that it will: <br />1. Causes the construction of said project to be completed within <br />two (2) years of the date of this contract in accordance with the <br />project plans and specifications and any necessary modification thereof <br />approved by the State. No payments will be made under this contract <br />until the project plans and specifications are approved by the State. <br />The above - mentioned time may be extended by the State if such time is <br />insufficient because of acts of God or other acts or circumstances <br />beyond the control of the Contractor. <br />2. Convey or cause title to be conveyed by deed or other proper <br />conveyance to the Colorado Water Conservation Board, Department of <br />Natural Resources, State of Colorado, the following portions of the <br />proposed project facilities: <br />a. A 24" Raw Water Transmission Line consisting of approximately <br />3800 lineal feet of ductile iron pipe beginning approximately <br />at the north right -of -way of Colorado Highway 6 and continuing <br />north generally adjacent to the east line of the NWa NWa of <br />Section 15 and the east line of the Whi SWa of Section 10, <br />all in Township 6 South, Range 93 West of the 6th Principal <br />Meridian, and ending at the new Graham Mesa Water Treatment <br />Plant. <br />Page 1 of S_ pages <br />*(See instructions on reverse of last page.) <br />
