Box 57, Winter Park, Colorado 80482 <br />hereinafter referred to as the contractor <br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made <br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4 0 0 8 <br />G/L Account Number 5 7 0 9 7 Contract Encumbrance Number C 1 5 3 3 1 6; and <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br />WHEREAS, *3 the State and the Contractor did, on November 1, 1979, <br />enter into a contract for State participation in the construction <br />of the Winter Park water supply pro' t for the members of the <br />Winter Park Water and Sanitation D' ct 'n Grand County, Colorado <br />at an estimated cost of Seven Hun if ousand Dollars <br />($750,000), which contract is at d as exhibit "A" and <br />hereby incorporated into this d ct; and <br />WHEREAS, the State and the C ntr have agreed to amend the <br />original contract marked as exhib' to reflect an additional <br />One Hundred Fifty Thousand Doll 150,000) authorized to the <br />Winter Park water supply projec' Senate Bill 67, Fifty - Second <br />Regular Session of the General Assembly, which money is considered <br />necessary to complete the protect. <br />NOW TIIEREFORE, in consideration of the mutual and dependent <br />convenants herein contained, it is agreed by the parties hereto <br />as follows: <br />1. The terms and provisions of that certain contract dated <br />November 1, 1979, attached hereto as exhibit "A" and incorporated <br />herein by reference, remain in full force and effect except as <br />amended herein. <br />2. Paragraph A.3 is hereby amended to read as follows: <br />3. Convey or cause title to be conveyed by deed or other <br />proper conveyance to the Colorado Water Conservation Board, <br />Department of Natural Resources, State of Colorado, the <br />following portions of the proposed project facilities: <br />ia) A 300 gpm treatment plant located adjacent to the <br />Fraser River approximately 200 feet downstream of the <br />U.S. 40 - Fraser River Crossing. Also, a building <br />shell to include above treatment plant. <br />(b) One 300,000 gallon storage tank located above the <br />Mary Jane Lodge and adjacent to the existing 80,000 <br />gallon Mary Jane storage tank. <br />(c) Land and easements within which (a) -(d) will be <br />1 -• <br />�^.r�ua.cd. <br />3. Paragraph A.10 is hereby amended to read as follows: <br />10. To purchase from the State all of the State's right, <br />title, and interest in said project and any facilities <br />thereof at a total purchase price of One Million Five <br />Hundred Sixty -One Thousand Four Hundred and Ten,Dollars <br />;$1,561,410) payable in thirty (30) annual installments <br />Of Fifty -Two Thousand Forty -Seven Dollars ($52,047) each, <br />which first installment shall be due and payable on <br />September 1, 1982 and yearly thereafter until the entire <br />Page 1 of 4 pages <br />*(See instructions on reverse of last page.) <br />
