<br />FIRST. The corporate name and style of our said corporation shall be "THE PISGAH RESER-
<br />VOTR AND DITCH COMPANY "
<br />SECOND. The objects for which our said corporation is formed and incorporated are as follows:
<br />1. (as amended 12/3/2001) To acquire by purchase, lease, or in any other manner and to
<br />operate, maintain and own water and water rights, reservoirs, canals, ditches, flumes, pipe - lines,
<br />laterals, pumping plants and equipment, and for the purpose of appropriating, storing, taking,
<br />conducting, exchanging, augmenting and distributing water for domestic, irrigation, municipal,
<br />industrial, recreational, piscatorial, and all other beneficial purposes, all as a mutual ditch company.
<br />and to do any and all other acts and things that may be necessary, expedient or incident to the
<br />enjoyment of and to carry out said objects and purposes and the objects and purposes hereinafter set
<br />forth
<br />2. To acquire by purchase, lease, or in anv other manner, real estate of every kind or descrip-
<br />tion necessary or proper in connection with the business of said company, and to carry on its objects
<br />and purposes as herein set forth.
<br />3. To acquire and to own, use, maintain, possess and enjoy any and all real estate, franchises,
<br />rights of way and easements which may be necessary, proper or desirable for any and all ditches,
<br />reservoirs, laterals, flumes, tunnels, embankments, pipes, pipe- lines, feeders, water ways, bridges and
<br />other accessories and appurtenances thereto for any of the objects or purposes of this company; and
<br />also to own and enjoy any and all tools, implements, machinery, fixtures and other personal property
<br />which shall be necessary or desirable for the advancement, promotion or convenience of any of the
<br />objects or purposes of this company.
<br />4. (as amended 12/3/2001) To appropriate, convey, store, exchange, augment, distribute and
<br />supply water for domestic, irrigation, municipal. industrial, recreational, piscatorial and all other
<br />beneficial purposes.
<br />5. To borrow money for the uses of the company and in furtherance of its objects and purposes
<br />and to mortgage or pledge in such manner as may be deemed advisable, the water, water rights.
<br />reservoirs, real estate, franchises, ditches, laterals, privileges and other property belonging to the
<br />company, or any part thereof,, as security for the repayment of money so borrowed on such terms and
<br />conditions as may be deemed advisable.
<br />6. To issue bonds and other obligations in payment for any property purchased or acquired by
<br />the company, or for any other object or purpose, in or about its corporate business, to mortgage or
<br />pledge stocks, bonds, or other obligations, or any property real, personal and mixed, including
