DRAFT - 9/26/01 <br />SECWCD - AURORA IGA <br />needs, including reoperation of existing water storage in Fry -Ark Project East Slope reservoirs <br />( "Reoperations "), followed by construction of the Enlargements to Pueblo Reservoir and <br />Turquoise Reservoir; <br />Whereas, the PSOP Report deferred the decision whether to allow Aurora to participate <br />in the Enlargements to a later time, after the extent of participation by Arkansas River Basin <br />entities was determined; <br />Whereas, following the PSOP Report, representatives of Southeastern, PSOP Participants <br />and others have participated in a Storage Implementation Committee, which developed the <br />Implementation Committee Report dated April 19, 2001; <br />Whereas, Southeastern filed applications for conditional water storage rights for the <br />Enlargements in Case Nos. OOCW138 (Pueblo Reservoir Enlargement) and OOCW139 <br />(Turquoise Reservoir Enlargement), Water Court, Water Division No. 2; <br />Whereas, both Aurora and the Rocky Ford Ditch Sellers Group have filed statements of <br />opposition in Case Nos. OOCW138 and OOCW139, and Aurora has also filed a Statement of <br />Opposition in the pending Case No. 99CW160 filed by Southeastern (seeking appropriative <br />rights of exchange on Grape Creek); <br />Whereas, Southeastern has determined that federal legislation is necessary to implement <br />the components of the PSOP Report; <br />5 <br />
