Recitals <br />Whereas, the Fry -Ark Project was authorized by the Act of Congress approved August <br />16, 1962 (76 Stat. 389), as amended, as a multi- purpose reclamation project under the 1939 <br />Reclamation Projects Act; <br />Whereas, the United States, acting through the Secretary of the Interior, constructed the <br />Fry -Ark Project as set forth in House Document 187, 83rd Congress, modified as proposed in the <br />September 1959 report of the Bureau of Reclamation entitled "Ruedi Dam and Reservoir, <br />Colorado," House Document 353, 86th Congress, 2nd Session, with such proper minor <br />modifications, omissions, or additions as were necessary to carry out the objectives of the <br />project, for the purpose of supplying water for irrigation, municipal, domestic, and industrial <br />uses, generating and transmitting hydroelectric power and energy, controlling floods, and for <br />other useful and beneficial purposes incidental thereto; <br />Whereas, Southeastern has assumed responsibility to repay the United States' <br />construction costs for the Fry -Ark Project pursuant to Contract No. 5- 07- 70- W0086, as amended, <br />between Southeastern and the United States; <br />Whereas, consultants to the Southeastern Colorado Water and Storage Needs Assessment <br />Enterprise, a separate water activity enterprise formed by Southeastern, prepared a Preferred <br />Storage Options Plan report, dated September 21, 2000, which PSOP Report identifies estimated <br />future water storage needs of several potential participants and outlines a plan for meeting those <br />4 <br />
