DRAFT - 9/26/01 <br />SECWCD - AURORA IGA <br />C. Any contract for Aurora's use of Fry -Ark Project facilities shall be <br />on an "if -and- when" basis, providing that Aurora's water stored in Fry -Ark <br />Project facilities shall be spilled consistent with the spill priorities set out in <br />Article 13 of Contract No. 5- 07- 70- W0086, as amended, between Southeastern <br />and the United States. <br />d. Aurora's use of excess capacity in the Fry -Ark Project facilities <br />shall be limited to use of Fry -Ark Project East Slope facilities for diversion, <br />storage and exchange of those Arkansas River Basin water rights that Aurora <br />currently owns and uses pursuant to decree, as well as those Rocky Ford Ditch <br />water rights for which application has been made in Case Nos. 99CW 169 and <br />99CW 170, those Lake County water rights for which application has been made <br />in case Nos. 99CW 137, and water available to Aurora from temporary water lease <br />agreements; Aurora shall not use Fry -Ark Project facilities in connection with any <br />further transfers of water rights that originate in the Arkansas River Basin. <br />e. The Fry -Ark Project Operating Principles and Allocation <br />Principles shall govern Aurora's use of Fry -Ark Project facilities, and provisions <br />of any contract executed by Aurora for such use shall assure that nothing shall <br />impair or otherwise interfere with: <br />i. the Fry -Ark Project's authorized purposes; <br />11 <br />
