In the lower basin, streamflows are generally less that 50 percent of <br />normal. To date, 6.5 months into 2004, the cumulative streamflow volume measured at Arkansas <br />.River at Avondale is about 200,000 acre -feet, which is nearly equivalent to YTD (year -to -date) <br />streamflow volume that occurred in 2003; the 2004 YTD cumulative streamflow volume is about <br />70 percent of the normal. The U.S. Geological Survey Colorado Drought Watch web page <br />{http / /co water usas aov /droueht) indicates that since January 2002 (about 2.5 years), there has <br />been about 800,000 acre -feet less streamflow than normal at Arkansas River at Avondale. <br />Mr. Edelmann said the report documenting the methods used to identify real -time and long -term <br />changes in water quality using dissolved -solids concentrations and loads for selected sites in the <br />Arkansas River and Fountain Creek has been published and is available on the web at <br />httQ/ /nubs water uses goy /sir20045024. People interested in knowing how current water quality <br />conditions compare to historic conditions and whether general water quality conditions are <br />significantly different than historic conditions with respect to salinity can access the real -time <br />and long -term water quality conditions web page at http7//co water usgs Qov /projects /ArkOW. <br />The web page provides users access to multiple plots that compare current water quality <br />conditions to a threshold and allows the user to determine when a significant adverse water <br />quality condition occurs. <br />Attorney Lee Miller said a request had been made for the Board to enter into Executive Session, <br />for the purpose of <br />C.R.S. §24- 6402(4)(b): (Conferences with an attorney for the local public body for the <br />purposes of receiving legal advice on specific legal questions) <br />C.R.S. §24- 6- 402(4xe): (Determining positions relative to matters that may be subject to <br />negotiations; developing strategy for negotiations; and instructing negotiators) <br />To discuss the following matters: <br />• Legal issues and strategy associated with the High Plains A & M litigation, <br />• Legal issues and strategy associated with Southeastern's Boustead Tunnel Enlargement <br />applications, including the Twin Lakes exchange; and <br />• Legal issues and strategy associated with Rocky Ford's transfer case and IGA with <br />Aurora <br />Mr. Miller said that there was no longer a quorum present, therefore, the Board would not be <br />able to take action on any items resulting from the Executive Session or any further agenda <br />items. He stated that the remaining Board members, although not constituting a quorum for <br />action items, could act on a motion to enter into Executive Session, because there were sufficient <br />members present to constitute a meeting under the Colorado Open Meetings Act. <br />EXECUTIVE SESSION: <br />Mr. Miller reported the presence of the following persons was requested at this Executive <br />Session: <br />• Non - Excused Board members (Mr. Aschermann indicated he would not participate in <br />discussion of the third item.) <br />• Executive Director <br />• Legal Counsel for the District <br />• Chief Financial Officer <br />• Water Resources Manager <br />• Minute taker (for non - attorney - client portions of the Executive Session) <br />Mr. Miller indicated that no minute -taker was necessary because all discussions in the Executive <br />Session were anticipated to be attorney- client privileged communications. Mr. Bailey moved, <br />seconded by Mr. Aschermann, to convene into Executive Session. Motion unanimously carried. <br />
