SECWCD <br />August 18, 2005 <br />5 <br />RECORD OF PROCEEDING <br />DIRECTOR OF ENGINEERING & RESOURCES MANAGEMENT REPORT: <br />Water Resume Report <br />Mr. Hamilton reported there was no follow -up reports on the June resumes as there were no <br />cases of interest from either Division 2 or Division 5. <br />Mr. Hamilton reported in the July 2005 Resume in Water Division 2, there were four (4) cases of <br />interest. <br />1. Case No. 05CW47 —Rancho De Caballeros Homeowners Association in Chaffee County. <br />This application is a surface water right of two cubic feet per second (2.0 cfs) of water <br />from "naturally" occurring seep and springs from a parallel ditch. <br />2. Case No. 05CW50 - Johnny A. Herndon. Application for Surface Water Right for fifteen <br />gallons per minute to irrigate 334- acres. The water would be diverted by excavating a <br />pond where an existing spring now exists and then pumping the water out of the pond. <br />In the above two cases, Mr. Hamilton will consult with staff from the Division Engineer's Office <br />and make recommendations for action, if necessary, at the September Board Meeting. <br />Case, 05CW52, is a joint application by LAWMA and Broyles Land & Water, LLLP for <br />a change of water rights on the Keesee Ditch in Bent County. LAWMA owns one half of <br />the Keesee and has an option to purchase the other half from Broyles. As the District is <br />already involved with LAWMA in another ongoing case involving LAWMA's Keesee <br />water rights, Mr. Hamilton recommended no action at this time, but will have a <br />recommendation at the September Board meeting. <br />4. The joint application for Diligence and to Make Absolute a portion of decreed exchange <br />of the Upper Arkansas Water Conservancy District, Town of Buena Vista, and the <br />Southeastern District. This exchange is an exchange of Fry -Ark Project water up <br />Cottonwood Creek to Rainbow Lake, Cottonwood Lake, and the Town of Buena Vista's <br />Town Intake and the Buena Vista Infiltration Gallery. Southeastern District is involved <br />because we supply the water for the exchange. <br />Mr. Hamilton reported in the July 2005 Resume for Water Division 5 there are no cases of <br />interest in Division 5. <br />Mr. Leonhardt reported in LAWMA's filing application on the second Keesee case, LAWMA <br />would like to settle both cases at the same time. <br />
