SECWCD <br />February 16, 2006 <br />4 <br />RECORD OF PROCEEDING <br />PUBLIC HEARING FOR ROLLING HILLS RANCH APPLICATION FOR INCLUSION: <br />President Stealey called the hearing to order. It is February 16, 2006, at approximately 1:00 p.m. <br />This is the Public Hearing on the petition for inclusion filed by Rolling Hills Ranch, for inclusion of <br />1,840.738 acres of property into the Southeastern Colorado Water Conservancy District. <br />President Stealey asked if a representative of the petitioner present. — (Ingrid Richter & Les Gruen <br />of Urban Strategies were present). He said the Board would hear from them after staff provides its <br />input into this petition. President Stealey asked if there were any objectors who have provided <br />written comments. There were none. <br />President Stealey asked Bob Hamilton to provide staff's report on this petition. <br />Mr. Hamilton said this is the Public Hearing on the petition for inclusion filed by Rolling Hills <br />Ranch, for inclusion of 1,840.738 acres of property into the Southeastern Colorado Water <br />Conservancy District, pursuant to Colorado Revised Statutes, Section 37 -45 -136. <br />At its Board Meeting on January 19, 2006, the Board ordered that notice of the filing of this petition <br />to be published in a newspaper of general circulation within the county where the land is located, <br />which notice must consist of three publications once a week for three consecutive weeks, and that <br />the notice state the filing of this petition, the name of the petitioner, and a descriptions of lands - -- <br />giving notice to all persons interested to appear at this time and location to show cause in writing <br />why the petition should not be granted, and that this Hearing must be held within 30 days of the last <br />publication -- pursuant to Colorado Revised Statute Section 37 -45- 136(2). <br />This notice was published in the Colorado Springs Gazette, a newspaper of general circulation in El <br />Paso County. A copy of the newspaper's affidavit of publication is in the public record. The last <br />publication date was February 12, 2006, which was less than 30 days ago. <br />Mr. Hamilton reported a petition was received on August 12, 2005 from Madison Orchards, LLC, <br />requesting that its property be annexed into the District. The name of the Petitioner has formally <br />changed to Rolling Hills Ranch. Upon receipt of this petition staff asked legal counsel to provide <br />an opinion on the sufficiency of the petition. Legal counsel indicated that this petition was in <br />compliance with the Water Conservancy inclusion statute found in Colorado Revised Statutes, <br />Section 37 -45 -136. <br />Staff has determined the following: <br />- -The legal description is adequate. <br />- -The total acres included in this petition is 1,840.738 (A plat map is in your packet) <br />- -The assessed valuation for 2005 is $9,846.00. <br />-- Required signatures on the petition were properly notarized, as required by statute. <br />
