DISTRICT COURT, WATER DIVISION NO. 6, STATE OF COLORADO <br />Case No. 81CW245 <br />----------------------------------- <br />RESPONSE TO NOTICE TO SHOW PROGRESS <br />CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE <br />DIVISION OF WATER DEVELOPMENT, DEPARTMENT OF ECONOMIC <br />PLANNING AND DEVELOPMENT, STATE OF WYOMING <br />IN ROUTT COUNTY ( NSc.f <br />LO <br />--------------------------------------- - - - - -- _ -- -- 144a d,17 <br />J <br />The law firm of Moses, Wittemyer, Harrison and <br />Woodruff, P.C., Boulder, Colorado, hereby enters its <br />appearance as counsel for the applicant in this proceeding. <br />By said counsel, the applicant responds to the Court's <br />Notice to Show Progress dated April 8, 1983.• Pursuant to <br />Rule 19 of the Rules of the Fourteenth Judicial District <br />and C.R.C.P. Rule 121(b) Section 1 -10, applicant shows <br />cause why the application herein should not be dismissed <br />for lack of prosecution, as follows: <br />1. The application herein was filed in November <br />of 1981, as a result of legislation enacted by the Wyoming <br />Legislature in 1979, 1980 and 1981 authorizing and <br />appropriating funds for study of the proposed Stage III of <br />the Little Snake River Water Development Project, of which <br />the proposed Three Forks Reservoir is a part. (See W.S. <br />41 -2 -204, 206 -207; Wyo. Sess. Laws, 1981, ch. 26, p. 535). <br />2. Pursuant to legislation enacted by the <br />Wyoming Legislature in 1982 (Wyo Sess. Laws, 1982, ch. 60), <br />the Wyoming Water Development Commission has responsibility <br />for planning and funding of twenty -nine (29) water <br />development projects in Wyoming, including the Little Snake <br />River Water Management Project of which Three Forks Reservoir <br />is a part. <br />3. A feasibility study of Stage III of the <br />Little Snake River Water Management Project, including <br />Three Forks Reservoir, has been completed, but further <br />studies will be necessary to determine the final <br />configuration of the project. The Wyoming Legislature <br />in 1982 appropriated $20 million for completion of <br />
