g. Identification of any construction camp locations and operations <br />within the easement area and dates durirg which construction <br />activities will occur. <br />h. Post construction cleanup. <br />i. Annual schedule of construction activities. <br />12. As a further guarantee of the faithful performance 'of the provisions <br />of clauses 1, 2, 5, 8, 11, and 12 of this Stipulation, the Grantee <br />agrees to deliver and maintain a surety bond in the amount of One <br />Hundred Thousand Dollars ($ 100, 000). Prior to undertaking additional <br />construction or alteration work not provided for in the above clauses <br />or when the improvements are to be ' removed and the area restored, the <br />Grantee shall deliver and maintain a surety bond in an amount set by <br />the Forest Service, which amount shall not be in excess of the <br />estimated loss which the Grantor would suffer upon default in perfor- <br />mance of this work. Should the sureties or the bonds delivered under <br />this Stipulation become unsatisfactory to the Forest Service, the <br />Grantee shall, within thirty (30) days of demand, furnish a new bond <br />with surety, solvent and satisfactory to the Forest Service. In lieu <br />of surety bond, the Grantee may deposit into a Federal depository, as <br />directed by the Forest Service, and maintain therein, cash in the <br />amounts provided for above, or negotiable securities of the Grantor <br />having a market value at time of deposit of not less than the dollar <br />amounts provided above. <br />The Grantee's surety bond will be released, or deposits in lieu of <br />bond, will be returned thirty (30) days after certification by the <br />Forest Service that priority installations under the develognent plan <br />are complete, azx3 upon furnishing by the Grantee of proof satisfactory <br />to the Forest Service that all claims for labor and material on said <br />installations have been paid or released and satisfied. The Grantee <br />agrees that all moneys deposited under this stipulation may, upon <br />failure on his part to fulfill all and singular the requirements <br />herein set forth or made a part hereof, be retained by the Grantor to <br />be applied as far as may be to the satisfaction of his obligations <br />assumed hereunder, without prejudice whatever to any other rights and <br />remedies of the Grantor. <br />13. The Grantee shall be responsible for the prevention and control of <br />soil erosion and gullying on the area covered by this grant and <br />lands adjacent thereto, and shall take preventive treasures as <br />required by the Forest Supervisor. <br />14. A muffler or spark arrester satisfactory to the Forest Service shall <br />be maintained on the exhausts of all trucks and tractors or other <br />internal combustion engines used in connection with this grant. <br />15. Each gasoline powersaw shall be equipped at all times with spark - <br />arresting muffler, in good working condition, adapted to that <br />machine. During periods of dangerous fire weather, as determined by <br />the Forest Service, the Grantee shall be required to transport and <br />keep with each powersaw at all times such fire tools and portable <br />extinguishers as specified and to take other precautionary measures <br />.as may be required by the Forest Service. <br />4 <br />6 <br />
