During the progress of developing the program plan all <br />operations of the Parties pertaining to the development of this <br />plan shall be open to inspection by the coordinating <br />representatives of the Parties or their designees. <br />CONTINGENT ON APPROPRIATION OR ALLOTMENT OF FUNDS <br />12. The expenditure or advance of any money or the performance <br />of any obligation by the United States under this Agreement shall <br />be contingent upon appropriation or allotment of funds by <br />Congress. Absence of appropriation or allotment of funds shall <br />relieve the Cooperating Partners from any obligation under this <br />Agreement. No liability shall accrue to the United States in <br />case funds are not appropriated. <br />UNUSED FUNDS <br />13. In the event that any funds advanced to Reclamation are not <br />required to complete the work program, such excess funds shall be <br />returned by Reclamation to the Cooperating Partners in the same <br />proportion that they were advanced, within 60 days of completion <br />of the program plan or of the termination date specified in <br />Section 14, whichever is earlier. <br />TERMINATION <br />14. The Parties may terminate this Agreement effective 90 days <br />after delivery to the other Parties of written notice of <br />termination. <br />AVAILABILITY OF INFORMATION <br />15. a. All information and data obtained or developed by <br />Reclamation, in connection with development of the program plan <br />(exclusive of intra- governmental communications) shall be <br />available upon request, except where prohibited by law, to the <br />Cooperating Partners. However, use of said reports, data, and <br />information shall appropriately reference Reclamation as the <br />source. <br />b. All parties recognize that the information developed is <br />public information and available for release upon request. <br />
