Mr. Vidal in the course of his argument made such a <br />statement verbatim and prefaced it with the remark that he <br />was authorized by the proper Colorado official to m ake the <br />statement. A copy of the statement was furnished to Mra <br />Kirgis . <br />Upon my return to Denver, I called Mr. Kirgis, He said <br />that the Justice Department had -jade a report to the War De-- <br />partzment pointing out the.statement and also the following <br />sentence appearing on page 53 of the Colorado Reply Briefs <br />"If the Kansas intent is to relinquish all rights <br />to Caddoa Reservoir, Colorado will accept the <br />responsibility of endeavorin3 to work out with <br />.the coxes of engineers, a program for the Most <br />beneficial use of the conservation f acilities <br />of this ,(Caddoa) Reservoir." <br />Mr. Kirgi.s stated it to <br />partment would be satisfied <br />made by the United States to <br />,Arkansas River Case.. <br />JSB : ew <br />be his opinion that the War De- <br />and that no attempt would be <br />intervene at this time, in the <br />-2- <br />Very truly .yours, <br />Joan S, Breitenstein <br />
