Kansas <br />At the time of the argument of the Arkansas River Case <br />before the United States Supreme Court, Frederic L. Kirgis, <br />Special Assistant to the Attorney General, and Walter HF <br />.Williams, Attorney Department of Justice, were present to <br />hear the argument and report to the Justice Department. As <br />you know, both Mr. Kirgis and Mr. Williams are counsel for <br />the United States in the North Platte Suit, Mr. Kirgis told <br />me that they were present primarily because the War De- <br />partment had, a few days previously, requested the Justice <br />Department to consider the desirability of the intervention <br />by the United States, in' the Arkansas Case, to protect what* <br />ever interests the United States may have by reason of the <br />construction of Caddoa Reservoir* Mr Kirgis and Mr. Williams <br />expressed the thought that the necessity for such Interven- <br />tion would be obviated if a clear statement were made to <br />the effect that Colorado recognized the Federal interest in <br />Cdddoa and was not attempting to supersede the Federal agency <br />in charge of C addoa o <br />That evening tho matter was discussed by Attorney Gen. <br />eral Ireland, Mr. Gordon., filar. McHendrie, Mr. Vidal and me. <br />It was concluded that Yr• Vidal in presenting the closing <br />argument for Colorado,, should make a statement along line re- <br />quested by Mr. Kirgis and Mr. Williams. Accordingly, the <br />following statement was prepared, <br />"Colorado realizes that the United States <br />constructed this (Caddoa) Reservoir and <br />that such rights as exist by reason of this <br />fact remain In the United States until there <br />usp in agreed to by the United States," <br />
