October 18, 1943
Hon„ Clifford Ho Stone, Director,
Colorado Water Conservation Board,
State Office Building,
Denver, Colorado.
Dear Judge Stone t
In re: Colorado v. Kansas
At the time of the argument of the Arkansas River Case
before the United States Supreme Court, Frederic L. Kirgis,
Special Assistant to the Attorney General, and Walter HF
.Williams, Attorney Department of Justice, were present to
hear the argument and report to the Justice Department. As
you know, both Mr. Kirgis and Mr. Williams are counsel for
the United States in the North Platte Suit, Mr. Kirgis told
me that they were present primarily because the War De-
partment had, a few days previously, requested the Justice
Department to consider the desirability of the intervention
by the United States, in' the Arkansas Case, to protect what*
ever interests the United States may have by reason of the
construction of Caddoa Reservoir* Mr Kirgis and Mr. Williams
expressed the thought that the necessity for such Interven-
tion would be obviated if a clear statement were made to
the effect that Colorado recognized the Federal interest in
Cdddoa and was not attempting to supersede the Federal agency
in charge of C addoa o
That evening tho matter was discussed by Attorney Gen.
eral Ireland, Mr. Gordon., filar. McHendrie, Mr. Vidal and me.
It was concluded that Yr• Vidal in presenting the closing
argument for Colorado,, should make a statement along line re-
quested by Mr. Kirgis and Mr. Williams. Accordingly, the
following statement was prepared,
"Colorado realizes that the United States
constructed this (Caddoa) Reservoir and
that such rights as exist by reason of this
fact remain In the United States until there
usp in agreed to by the United States,"
