46 <br />X11 the time that the transfer decree was entered transferring <br />21j 20,000 acre -feet to the Trinidad Reservoir. That much of it <br />3 was reported to you at the December meeting. <br />4 Going from that point forward, the only thing <br />5 really that's happened since then has been the decision, in <br />6 chronological order now, the decision of the Supreme Court in <br />7 the Model cas.e saying in fact the Model transfer was final. <br />8 Briefing has taken place. <br />g The last briefs in the Trinidad case have been <br />10 written, with possilby the exception of the United States which <br />11 appeared as amicus curiae. At least the United States did file <br />12 a brief as a, what we call, a friend of the court. They have <br />13 an opportunity to reply to the answer brief which I filed on <br />14 behalf of several companies. The last time I was in my office, <br />15 which was last week, they had not yet replied, but if they <br />16 have replied, that will be the last brief in. The case will <br />17 be set for argument to the Colorado Supreme Court perhaps three <br />18 four, maybe even five. months from now, and following that, the <br />19 Supreme Court will issue its decision. Its.decision will <br />20 directly affect the 13,800 acre -feet of storage space, there's <br />21 no question about that, it will have to rule on that question. <br />22 I suspect that the Supreme Court, knowing that <br />23 the abandonment question was on its way up, decided deliberately <br />24 to delay any decision on the abandonment question until it had <br />25 the facts before it. <br />
