40 <br />111 immediately, the water, down to those downstream junior <br />2 appropriators. <br />3 To sum up the judge's comments after the conclusion <br />4 of the trial, the judge has said, and these are his words and <br />5 I don't want to go beyond his words because somebody might <br />6 think I am speaking for the judge and I certainly do not, he <br />7 said he will probably find injury. He said those words.followin <br />8 a Motion to Dismiss which I argued to him after the first five <br />9 clays of the trial and that was just two days ago. <br />10 Yesterday the objectors put on their case and, <br />11 in addition to the objectors' case, a certain portion of <br />12 rebuttal was put on yesterday. <br />13 This morning the last rebuttal witness was called <br />14 and his testimony and his cross -- examination was finished. <br />15 Following that, the judge again said that he <br />16 would probably find injury. He has directed counsel for the <br />17 applicant first to present proposed findings, conclusions, and <br />18 judgment, and decree, to him within 30 days. Following that, <br />19 <br />all counsel for objectors are given <br />another 30 <br />days to present <br />20 <br />proposed findings, conclusions, and <br />so forth, <br />to him. Followin <br />21 <br />that, there will be a decision made, <br />findings <br />and conclusions <br />22 <br />will be entered and a decree will be <br />entered. <br />The decree -will <br />23 <br />provide that the applicant will have <br />the opportunity to suggest <br />24 <br />terms and conditions to, let's say, <br />correct or remedy whatever <br />25 <br />injury the water court eventually finds. <br />
