COLORADO DEPARTMENT OF PERSONNEL and ANDRE PETTIGREW, Executive Director of the Colorado Department of Personnel in his official capacity, Defendants. Defendants, by. the Attorney General for the State of Colorado, request a second enlargement of time in which to file an answer brief in response to the opening briefs filed on behalf of the plaintiffs and as grounds therefor, state as follows: 1. This matter consists of three consolidated judicial review actions involving members of two different employee organizations and one group of employees appearing pro se. 2. All plaintiffs have filed opening briefs. The last opening brief was filed on or about December.9, 1998, on behalf of the plaintiffs represented through the Colorado Association of Publice Employees (CAPE). 3. Defendants' answer brief is due no later than December 28, 1998, pursuant to an enlargement of time granted by the Court on November 25, 1998. 4. Counsel for the plaintiffs represented through the Colorado Federation of Public Employees (CFPE) was contacted by Defendants' counsel and has no objection to this motion. Defendants' counsel attempted, but was unable, to contact counsel for the CAPE plaintiffs, who is on annual leave. Furthermore, Defendants' counsel left a telephone message for Ms. Illian of the pro se plaintiffs advising her of this motion. 5. Defendants request a second enlargement of time through January 18; 1999, in which to file an answer brief.
