District Court, Water Division 5, Colorado: Case No. 06CW77; Application for water rights of Town of Carbondale <br />Statement of Opposition <br />Page 2 of 4 <br />and its water marketing customers to promote maximum utilization of the State's <br />water resources by reducing the ability to use the River District's water resources by <br />exchange. <br />b. The River District, by virtue of and in compliance with its statutory powers and <br />duties, is the owner and claimant of absolute and conditional water rights in the <br />Roaring Pork and Crystal River basins. <br />Applicant must prove that the claimed water is available for appropriation, without <br />injury to existing rights. <br />Applicant must meet all applicable standards for RICD water rights established by <br />law. <br />e. The River District reserves the right to raise additional objections at a later date based <br />on information not readily ascertainable from the Application, and to participate fully <br />in factual and legal issues in this case that are raised by other parties. <br />"17tis Statement of Opposition is intended to be continuing in nature and to apply to <br />all further amendments to the Application, regardless of form.
