The City and Pueblo West previously entered into Stipulations in this matter, dated February 25, 2002 (the "February Stipulation ") and August 29, 2002 (the "August Stipulation "). In the August Stipulation, the City and Pueblo West agreed, among other things, that they would conduct further discussions regarding the City's application in this case, before November 29, 2002, in an attempt to reach an agreement to satisfy certain specified concerns of Pueblo West and that in the event such an agreement were not reached by November 29, 2002, the City would not object to Pueblo West's filing a motion to intervene and a statement of opposition herein during November 2002. 2. As of November 25, 2002, the City and Pueblo West are continuing to discuss the matters identified in the February and August Stipulations, but have not yet
